Terms and Conditions

1. Introduction

Welcome to Taalam Learning Centre. These Terms and Conditions ("Terms") govern the enrolment of students in, and use of, our Madrasah and Arabic language programmes, delivered both onsite and online. By registering a child or yourself for our classes, or by otherwise using our services, you agree to comply with these Terms.

2. Definitions

• "We", "Us", "Our": Refers to Taalam Learning Centre.
• "You", "Parent", "Guardian": Refers to the parent, legal guardian, or adult learner enrolling with us.
• "Student", "Child": Refers to the individual enrolled in our classes.
• "Services": Refers to the Madrasah and Arabic language programmes described in Section 3.

3. Our Services

Taalam Learning Centre is an Islamic education establishment providing Qur'an, Islamic studies, and Arabic language tuition to children and adults, both onsite in Manor Park and online. Our programmes include:

• Madrasah Programme: Qur'an, Qaida and Islamic studies for children from Reception to Year 6, held onsite on weekday afternoons (1:00–2:45pm) and evenings (5:00–7:00pm), Monday to Thursday.
• Friday Arabic Classes: Onsite Arabic reading, writing and speaking classes held on Friday mornings (9:30–11:30am), from beginner level through to GCSE.
• Saturday Arabic Madrasah: An extended Saturday programme (10:00am–2:00pm) combining Arabic and Islamic studies, held in separate groups for boys (up to age 11) and girls (up to age 16).
• Live Online Arabic Tuition: Live online Arabic lessons for students across the UK, including preparation for Edexcel GCSE and A-Level Arabic qualifications.

4. Our Islamic Ethos and Code of Conduct

4.1. Our Commitment

As an Islamic education establishment, Taalam Learning Centre is committed to nurturing each student's knowledge, character (akhlaq) and love of the Qur'an and Arabic language. In doing so, we are committed to:

• Providing a safe, welcoming and inclusive learning environment for every student.
• Delivering teaching grounded in Islamic values and good character.
• Safeguarding the welfare of all children in our care at all times.
• Working in partnership with parents and guardians to support each student's progress.

4.2. Expectations of Students and Parents

To maintain a positive and respectful learning environment, students and parents/guardians are expected to:

• Attend classes punctually and regularly, whether onsite or online
• Show respect towards teachers, staff, volunteers and fellow students
• Observe modest dress and good Islamic etiquette (adab) during onsite and online sessions
• Refrain from using mobile phones or other devices during class other than for learning purposes
• Inform us promptly of any medical, behavioural or additional learning needs
• Refrain from any form of bullying, discrimination or disruptive behaviour
• Ensure a suitable, quiet learning space and working device/internet connection for online classes

5. Enrolment and Eligibility

• Registration: Places are offered subject to availability and completion of our registration form. Programme age criteria are set out in Section 3.
• Parental Consent: Where a student is under 18, enrolment must be made by a parent or legal guardian, who accepts these Terms on the student's behalf.
• Trial Class: New students may attend one free trial class before committing to ongoing enrolment.

6. Parent and Guardian Obligations

• Accurate Information: You agree to provide accurate and up-to-date information, including emergency contact and any relevant medical or educational needs.
• Drop-off and Collection: For onsite classes, you are responsible for the safe drop-off and collection of your child, or for arranging a nominated adult to do so.
• Notifying Absence: You agree to notify us in advance where possible if your child will be absent from a session.
• Code of Conduct: You confirm that you and your child will act in accordance with our Islamic Ethos and Code of Conduct set out in Section 4.

7. Fees and Payment

• Tuition Fees: Registration and termly or monthly fees are set out at the point of enrolment.
• Payment Terms: Fees are due in advance of each term or billing period, unless otherwise agreed in writing.
• Late Payment: We reserve the right to suspend a student's place if fees remain overdue, following reasonable notice to the parent or guardian.
• Refunds: Fees are non-refundable for individual sessions missed by a student, save at our discretion in cases of extended illness (with supporting evidence) or where we cancel a course.

8. Intellectual Property Rights

• Ownership: All teaching materials, worksheets, recordings and other resources provided as part of our Services remain the intellectual property of Taalam Learning Centre.
• Licence: We grant enrolled students and parents a non-exclusive, non-transferable licence to use these materials for personal educational purposes only.
• Restrictions: You shall not reproduce, distribute, resell or publicly share our materials or recordings of live sessions without our prior written consent.

9. Confidentiality

• Mutual Confidentiality: Both parties agree to keep confidential any personal or family information shared in the course of a student's enrolment.
• Safeguarding Exception: Nothing in this section prevents us from sharing information where necessary for safeguarding, child protection, or as required by law.

10. Data Protection

• Compliance: We process personal data, including data relating to children, in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR and the Data Protection Act 2018.
• Parent Responsibility: You are responsible for ensuring that any personal data you provide about your child is accurate and that you are authorised to share it with us.

11. Limitation of Liability

• Exclusion of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential losses arising out of or in connection with our Services or these Terms.
• Maximum Liability: Our total liability under these Terms shall not exceed the total fees paid by you for the Services in the 12 months preceding the claim.
• Online Sessions: For online classes, parents/guardians remain responsible for supervising their child's use of devices and the internet outside of the tutor-led lesson itself.

13. Withdrawal and Termination

• By Parent/Guardian: You may withdraw your child from our Services at any time by providing 30 days' written notice.
• By Us: We may suspend or terminate a student's place upon written notice for non-payment of fees or breach of our Code of Conduct, or immediately where necessary to protect the safety or welfare of any child.

12. Indemnification

You agree to indemnify and hold harmless Taalam Learning Centre, its teachers, volunteers, and staff from any claims, liabilities, damages, losses, or expenses arising out of your, or your child's, breach of these Terms.

14. Force Majeure

We shall not be liable for any failure or delay in delivering our Services due to circumstances beyond our reasonable control, including but not limited to adverse weather, natural disasters, pandemics, or governmental restrictions. Where reasonably possible, we will move affected sessions online or reschedule them.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Continued enrolment or use of our Services after any modifications indicates your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with your registration details and our Privacy Policy, constitute the entire agreement between you and Taalam Learning Centre regarding your child's enrolment and use of our Services, and supersede all prior agreements and understandings.

19. Waiver

No failure or delay by either party to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy.

20. Notices

Any notices or other communications required or permitted under these Terms shall be in writing and delivered to the contact details provided at registration, either by hand delivery, registered post, or email.
